Terms of Service

Payment & Refunds
PayPal is our preferred method of payment. If you pay by e-check through PayPal, work will not begin until the check has cleared.  We will also accept money orders purchases through the US Postal Service and again, work will not begin until the money has been received.

All sales are final.  Because of the nature of our products and services, the amount of time and effort involved in our line of work and copyright concerns, we do not issue refunds.  NO EXCEPTIONS!  I will refund a portion of money is a transaction is cancelled within the 24 hours period and graphics have not been sent yet, but I reserve the right to  keep a portion of the fee for any work I've already completed.

The Process

If you are purchasing a premade design, we will customize the design as outlined in it's description.  This is usually done in one to three days, although please remember, we do not work weekends to spend time with family.

If you are purchasing a custom design, we will send you a design questionnaire to help jump start the process!  This gives us an idea of the direction to take with the design of your site.

We strive to keep our prices affordable.  This means that we are often working with multiple clients at one time - with our low prices, it just isn't feasible to work with only one or two clients at a time - we'd go broke!  So, in order to keep our prices low, we work with several customers at a time - please keep this in mind :)

We will make every effort to have all work completed in 45 days provided the client is able to provide timely feedback and information required for completion of the site.  In the event we do not hear from the client for more than 10 days (unless you have notified us that you will be out of town, etc.) that client will be dropped to the bottom of the list and may have to wait until other projects are finished.

Revisions are a necessary part of the process!  We are happy to work with you until you are satisfied with your site, however, the revisions can not go indefinitely!  Therefore, we currently have a 5 revision limit with the opportunity to purchase additional revisions at a cost of $20 per revision.

 Your Part

The client agrees to authorize and grant Whimsical Web Design access to your website admin or shopping cart using your protected username and password so we can install the design and customize the store.

Graphics & Changes
No alterations or revisions of any kind are allowed on any of our products without our direct consent. If you would like to alter any of our designs, you must email us with the specifications and approvals will be made on a case-by-case basis.  Additionally, graphics are not to be resold or reused for any reason without prior written permission.  While you may use the graphics in the manner stated in your purchse, the copyright remains with the artist(s) who created the graphics.  What does that mean?  That means if you bought a set that includes a business card design, you can print business cards.  If you didn’t, no printing of the graphics, chopping them up, copying them, etc without written permission!!

Copyrights
All credit and copyright links at the bottom of the web design, eBay template, storefront and other works must remain in place for legal use of the design. These can not be removed under any circumstances.  Also, if the artist’s signature appears on a graphic, it may not be removed.

Other important stuff!!
All projects will be developed using various commercial software products.  We will make every effort to ensure that your product is fully functional, however, our warranty does not cover AOL, text-based browsers or any other special effects that we may advise against.
